Requirements for a fire safety declaration Order of the Ministry of Emergency Situations

1.1. Objects capital construction, for which the legislation of the Russian Federation on urban planning provides for a state examination, with the exception of:

detached residential buildings with a height of no more than three floors, intended for the residence of one family (objects of individual housing construction);

residential buildings with a height of not more than three floors, consisting of several blocks, the number of which does not exceed ten, and each of which is intended for one family, has a common wall ( common walls) without openings with the neighboring block or neighboring blocks, located on a separate land plot and has access to the territory common use(residential houses of the blocked building);

apartment buildings no more than three floors high, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to the common area;

detached capital construction projects with a height of no more than two floors, the total area of ​​​​which is not more than 1500 square meters and which are not intended for the residence of citizens and the implementation of production activities, with the exception of objects that are especially dangerous, technically complex or unique objects;

detached capital construction projects with a height of no more than two floors, the total area of ​​which is not more than 1500 square meters, which are intended for the implementation of production activities and for which the establishment of sanitary protection zones is not required or for which within the boundaries land plots where such facilities are located, sanitary protection zones have been established or the establishment of such zones is required, with the exception of facilities that are especially dangerous, technically complex or unique facilities.

1.2. Buildings of preschool educational institutions.

1.3. Specialized nursing homes and disabled people (not residential).

1.4. Hospitals.

1.5. Sleeping buildings of educational institutions of boarding type and children's institutions.

2. Declaration fire safety(hereinafter - the declaration) can be drawn up both as a whole for the object of protection, and for individual buildings, structures, structures and premises that are part of it, for which fire safety requirements are established.

3. The declaration is developed and submitted by the owner of the object of protection or by a person who owns it on the basis of the right of lifetime inheritable possession, economic management, operational management, or on another legal basis (hereinafter referred to as the declarant).

4. The declaration for the designed object of protection is drawn up by the developer or the person who prepares the project documentation.

5. For the designed objects of protection, the declaration is submitted before they are put into operation.

6. For objects of protection operated on the day of entry into force federal law dated July 22, 2008 N 123-FZ "Technical Regulations on Fire Safety Requirements" (hereinafter referred to as the Technical Regulations), the declaration is submitted no later than one year after the entry into force of the Technical Regulations.

7. The declaration of fire safety is specified or developed again in case of changes in the information contained in it or in case of changes in fire safety requirements.

8. The declaration is specified by making changes to it, which are attached to the declaration and registered in the manner established for the registration of the declaration.

9. The declarant who developed the declaration is responsible for the completeness and reliability of the information contained in it in accordance with the legislation of the Russian Federation.

10. The declaration is drawn up in accordance with the established form in two copies, signed by the declarant and sent to the territorial department (department, inspection) of the structural subdivision of the territorial body of the Ministry of the Russian Federation for Civil Defense, Emergencies and Disaster Relief - the body specially authorized to solve the tasks of civil defense and the tasks of preventing and eliminating emergency situations in the constituent entity of the Russian Federation, the scope of which includes the organization and implementation of state fire supervision (hereinafter - the body of the Ministry of Emergency Situations of Russia), directly or by mail.

11. The Ministry of Emergency Situations of Russia maintains a list of fire safety declarations in electronic form and on paper and enters into it the necessary information about the declaration within one working day from the date of its assignment registration number.

12. Officials of the EMERCOM of Russia body check the compliance of filling in the received declaration with the established form within five working days and, if the filling of the declaration complies with the requirements established for it, they register it by entering the necessary information into the list of fire safety declarations.

13. If filling out the declaration does not comply with the requirements established for it, officials of the EMERCOM of Russia body return the declaration to the declarant with a written indication of the reasoned reasons for refusing to register it.

14. Within three working days from the date of assignment of the registration number declaration, one copy of it is sent by the EMERCOM of Russia to the declarant, and the second copy is stored in the EMERCOM of Russia.

15. For registration in the list of fire safety declarations, the Ministry of Emergency Situations of Russia assigns a registration number to the declaration.

The structure of the registration number of the declaration consists of three parts.

The first part of the declaration number consists of the code of the locality and the code of the subject of the Russian Federation on whose territory the object of declaration is located, according to the All-Russian classifier of objects of administrative-territorial division OK 019-95 at the time of registration.

The second part of the declaration number is a serial number.

The third part of the declaration number is the number of the control and supervisory file in which it is stored.

The code of the settlement and the code of the subject of the Russian Federation according to the All-Russian classifier of objects of administrative-territorial division OK 019-95 consists of eight digits. Spaces are placed between the second and third, fifth and sixth digits of the locality code.

16. The decision to cancel the registration of the declaration is made by the EMERCOM of Russia in the event of:

submission by the declarant of false information;

changes in the owner of an object or a person who owns an object on the basis of the right of lifetime inheritable possession, economic management, operational management, or on another legal basis;

changes in the characteristics of the object of protection that affect the information contained in the declaration, and not providing information about this at the place of registration of the declaration.

17. The following information is recorded in the list of fire safety declarations:

registration number of the declaration and the date of its assignment;

full and abbreviated name of the operating organization (or project customer), design organization (for protected objects being designed), owner or other person who legally owns the protected object;

functional purpose of the object of protection;

surname, initials and position of the developer of the declaration;

full postal and electronic addresses, telephone, fax of the legal entity and the object of protection;

availability of additions to the declaration;

information about the status of the declaration (valid / canceled registration).

18. The provision of information contained in the list of fire safety declarations, at the request of interested organizations, is carried out by the EMERCOM of Russia free of charge in the form of extracts from the specified list.

1. The fire safety declaration is developed in accordance with Article 64 of the Federal Law of July 22, 2008 N 123-FZ "Technical Regulations on Fire Safety Requirements" and Article 49 of the Town Planning Code of the Russian Federation and is drawn up in relation to:

1.1. Capital construction projects for which the legislation of the Russian Federation on urban planning provides for a state examination, with the exception of:

1.2. Buildings of preschool educational institutions.

1.3. Specialized nursing homes and disabled people (not residential).

1.4. Hospitals.

1.5. Sleeping buildings of educational institutions of boarding type and children's institutions.

  • detached capital construction facilities with a height of no more than two floors, the total area of ​​which is not more than 1500 square meters, which are intended for the implementation of production activities and for which the establishment of sanitary protection zones is not required or for which sanitary protection zones are established within the boundaries of the land plots on which such objects are located or the establishment of such zones is required, with the exception of objects that are especially dangerous, technically complex or unique objects.

2. The fire safety declaration (hereinafter referred to as the declaration) can be drawn up both for the object of protection as a whole, and for individual buildings, structures, structures and premises that are part of it, for which fire safety requirements are established.

3. The declaration is developed and submitted by the owner of the object of protection or by a person who owns it on the basis of the right of lifetime inheritable possession, economic management, operational management, or on another legal basis (hereinafter referred to as the declarant).

4. The declaration for the designed object of protection is drawn up by the developer or the person who prepares the project documentation.

5. For the designed objects of protection, the declaration is submitted before they are put into operation.

6. For objects of protection operated on the date of entry into force of the Federal Law of July 22, 2008 N 123-FZ "Technical Regulations on Fire Safety Requirements" (hereinafter referred to as the Technical Regulations), the declaration is submitted no later than one year after the entry into force of the Technical Regulations.

7. The declaration of fire safety is specified or developed again in case of changes in the information contained in it or in case of changes in fire safety requirements.

10. The declaration is drawn up in accordance with the established form in two copies, signed by the declarant and sent to the territorial department (department, inspection) of the structural subdivision of the territorial body of the Ministry of the Russian Federation for Civil Defense, Emergencies and Disaster Relief - the body specially authorized to solve the tasks of civil defense and the tasks of preventing and eliminating emergency situations in the constituent entity of the Russian Federation, the scope of which includes the organization and implementation of state fire supervision (hereinafter - the body of the Ministry of Emergency Situations of Russia), directly or by mail.

11. The Ministry of Emergency Situations of Russia maintains a list of fire safety declarations in electronic form and on paper and enters the necessary information about the declaration into it within one working day from the date of assigning a registration number to it.

12. Officials of the EMERCOM of Russia body check the compliance of filling in the received declaration with the established form within five working days and, if the filling of the declaration complies with the requirements established for it, they register it by entering the necessary information into the list of fire safety declarations.

13. If filling out the declaration does not comply with the requirements established for it, officials of the EMERCOM of Russia body return the declaration to the declarant with a written indication of the reasoned reasons for refusing to register it.

14. Within three working days from the date of assignment of the registration number declaration, one copy of it is sent by the EMERCOM of Russia to the declarant, and the second copy is stored in the EMERCOM of Russia.

15. For registration in the list of fire safety declarations, the Ministry of Emergency Situations of Russia assigns a registration number to the declaration.

The structure of the registration number of the declaration consists of three parts.

The first part of the declaration number consists of the code of the locality and the code of the subject of the Russian Federation on whose territory the object of declaration is located, according to the All-Russian classifier of objects of administrative-territorial division OK 019-95 at the time of registration.

16. The decision to cancel the registration of the declaration is made by the Ministry of Emergency Situations of Russia in the event of: the declarant submits false information; changes in the owner of an object or a person who owns an object on the basis of the right of lifetime inheritable possession, economic management, operational management, or on another legal basis; changes in the characteristics of the object of protection that affect the information contained in the declaration, and not providing information about this at the place of registration of the declaration.

The Ministry of Emergency Situations of Russia has developed the next changes to the procedure for registering a fire safety declaration. It is currently being reviewed. A notice about this was published on the official website of the ministry. True, this project is hidden there so that before you find it, you have to work hard. So use the link. As a matter of fact, the period of this examination will soon expire, it will last until May 3.

Yes, and these changes are few, literally two paragraphs. They concern the possibility of sending a declaration for registration in electronic form, as well as, again in electronic form, receiving notification of its registration. The draft order also provides for the possibility of filling it online, with the help of some, as yet non-existent, Internet resource.

Where do legs grow from?
And they grow from the order of the Government of the Russian Federation of March 15, 2012 N 341-r “On approval of the action plan for the comprehensive optimization of control, supervisory and licensing functions, the provision of public services, as well as to reduce excessive state regulation in the field of activity of the Russian Emergencies Ministry”. A very interesting order. While I don’t have a file directory on my blog, you can familiarize yourself with it. An extremely curious order, but I'm not talking about that now.

Paragraph 3 of the action plan approved by the said order provides for two, in fact, measures (sorry for the tautology):

- amendments to the Order of the Ministry of Emergency Situations of Russia dated February 24, 2009 N 91 "On approval of the form and procedure for registering a fire safety declaration", providing for the possibility of filing and registering declarations via the Internet, the introduction of a phased mode of filling them out (due date - June 2012);

Ensuring the possibility of filing and registering declarations via the Internet and the mandatory posting of templates (variants) of declarations on the Internet standard projects buildings and structures (due date - June 2013).

As you can see, the first part is already running.

As for the second, but here I am tormented by vague doubts. It's a good thing, but... I don't believe it! A software tool that allows you to set (select) fire safety requirements for the object of protection by its type and parameters has long been needed by everyone. First of all - to the inspectors of state fire supervision and state construction supervision. And the declaration of fire safety is not God knows what an epochal milestone. But ... there is no such thing! The most grandiose that the Ministry of Emergency Situations (Ministry of Internal Affairs, GUGPS, GUPO) in general and VNIIPO in particular have bothered to develop is a manual on regulatory and technical work. And only once. And it has never been updated. Well, yes, there was some other software tool, it seems to be called "Expert NV". But, apparently, it turned out to be somehow “crooked” and incomplete, and also never updated. So, it has not been widely adopted.

And here - swung! Already breathtaking from the prospects!
