When providing utility services with interruptions exceeding the established duration, the amount of payment for each utility service is also subject to a reduction in the amount of utility services not provided. The main regulatory document regulating relations between the subjects of the process of providing hot water supply is the Decree of the Government of the Russian Federation “On the provision of public services to owners and users of premises in apartment buildings and residential buildings" from 05/06/2011. No. 354. According to this resolution, namely, Appendix No. 1, a list of situations has been established when utilities can be turned off:

Permissible interruption of cold water supply: 8 hours (in total) within 1 month; 4 hours at a time, in case of an accident in centralized cold water supply networks in accordance with the requirements of the Russian Federation on technical regulation (SNiP 2.04.02-84).

Permissible duration of a break in the supply of hot water: 8 hours (in total) within 1 month; 4 hours at a time, and in the event of an accident on a dead end line - 24 hours, the duration of the interruption of hot water supply associated with repair and maintenance work is carried out in accordance with the requirements of the legislation of the Russian Federation on technical regulation (SanPin 2.1.4.2496-09).

Permissible duration of a water disposal break: 8 hours (in total) within 1 month; 4 hours at a time (including in case of an accident).

Permissible duration of interruption of gas supply: no more than 4 hours (in total) within one month.

Permissible duration of a heating break: no more than 24 hours (in total) within one month; no more than 16 hours at a time - at an air temperature in residential premises from 12 degrees C to the standard; no more than 8 hours at a time - at an air temperature in residential premises from 10 degrees C to 12 degrees C; no more than 4 hours at a time - at an air temperature in residential premises from 8 degrees C to 10 degrees C.

As a rule, all the dissatisfaction of the residents of comfortable apartments is caused enough long terms carrying out preventive work. According to paragraph 10 of this Order:

When providing utility services, breaks for repair and maintenance work, as well as work to connect new consumers are allowed after prior notice (in writing) to the consumer in the manner prescribed by these Rules. The duration of these breaks is established in accordance with these Rules and other requirements of the law. Russian Federation. Breaks due to natural disasters and emergencies are also allowed.

Other requirements of the legislation of the Russian Federation are understood as regulations that ensure sanitary and technical requirements(control over which is established in accordance with Articles 12, 13, 14 of the LC RF), namely:

1) Rules and norms for the operation of the housing stock, approved by the Decree of the Gosstroy of Russia No. 170 of September 27, 2003: Repair of heat networks, heat points and heat consumption systems should be carried out simultaneously in the summer. The recommended repair period associated with the termination of hot water supply is 14 days. In each case, the duration of the repair is determined by the local authorities.

2) Hygienic requirements for ensuring the safety of hot water supply systems, approved by the Decree of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare (Chief Sanitary Doctor of the Russian Federation) No. 20 of 04/07/2009: During the period of annual preventive repairs, turning off hot water supply systems should not exceed 14 days. For the period of repair, objects of increased epidemic significance (hospitals, boarding schools, schools and preschool institutions, etc.) are to be provided with hot water from their own reserve sources, which should be provided for at the design development stage.

At the same time, if in the first regulatory act it is allowed to exceed the period for carrying out maintenance work by more than 14 days, then in the second regulatory act this period is clearly established.

The planned shutdown of utilities, in accordance with clause 49 of the Procedure, must be accompanied by a notification to consumers no later than 10 working days before the start of the break.

Implementation state control compliance of residential premises, quality, volume and procedure for the provision of public services, regardless of the form of ownership, is carried out by the executive authorities of the constituent entities of the Russian Federation (in accordance with Article 13, Article 20 of the LC RF). Control over compliance with the procedure for the provision of public services is carried out by the executive authorities of the Russian Federation, executive authorities of the constituent entities of the Russian Federation and local governments within their competence (in accordance with clause 114 of the Procedure).

Who is responsible for these violations? To do this, it is necessary to determine who is the contractor providing hot water supply. Depending on how you manage your home, there may be several options:

1) Your home is served Management Company. In this case, the management company is the contractor, and the responsibility for providing hot water lies with it, regardless of whether it produces or acquires utility resources. In practice, very often management companies explain the absence of their fault, however, according to the Procedure, they are the executor who is responsible for the entire process of providing public services. And they should be the ones to answer.

Management companies like to refer to consumer debt, however, according to clause 80 of the Procedure, in order to suspend or restrict the provision of utility services, it is necessary to have a debt of 6 monthly fees, determined based on the relevant utility consumption standards. In this case, the performer is obliged to notify in writing about such a disconnection one month in advance, otherwise the disconnection is not performed. In addition, the contractor, in accordance with paragraph 85, paragraph 86 of the Procedure, cannot turn off hot water to consumers who fulfill their obligations. That is, if your neighbor improperly fulfills his obligations (for example, does not pay housing and communal services on time), then you do not have the right to turn off hot water and refer to this neighbor.

2) If you have an HOA, housing cooperative, then the responsibility for not providing hot water lies with the governing bodies.

In practice, disconnection often occurs when some consumers fail to pay their debts for housing and communal services. In this case, the HOA, the housing cooperative are a single consumer and are fully liable for their debts. In the first option, we have already discussed how the suspension or restriction of hot water should take place. At the same time, paragraph 86 of the Procedure does not unambiguously refer specifically to the consumer, but generally refers to the suspension or restriction of public services. In addition, there is an overview judicial practice of the Supreme Court of the Russian Federation for the 4th quarter of 2006, approved by the Resolution of the Presidium of the Supreme Court of the Russian Federation of March 7, 2007 (question 28), where the HOA, ZhSK were defined as an intermediary (since it is not a direct consumer) in the process of providing public services. Therefore, there is a rather difficult question here, how to position the HOA or housing cooperative, and whether it is possible to turn off conscientious payers in case of debts of other tenants.

3) In the case of direct management, in accordance with Article 164 of the Housing Code of the Russian Federation, each owner concludes independently an agreement for the provision of hot water supply. The contractor will be the one with whom this contract is concluded.

It is also important to know that according to paragraph 51, paragraph 77 of the Procedure, you have the right to demand payment by the contractor of forfeits (fines, penalties) in case of failure to provide utilities or utilities of inadequate quality, including compensation for losses and harm caused to life, health or property of the consumer (persons living together with him). At the same time, in accordance with clauses 75, 76 of the order, the utility service provider is liable, established by the legislation of the Russian Federation, for violating the quality and procedure for the provision of utility services. That is, the payment for the failure to provide utilities is not only not taken, but you also have the right to demand penalties.

The biggest lucky ones among the residents of Moscow in May and June can be considered the owners of water heaters. Traditionally, preventive work forces residents of the capital to patiently boil water in kettles, go to a bathhouse or a fitness club just to wash themselves. And although scheduled outages last no more than ten days, this short period is always accompanied by an obvious domestic inconvenience. Why turn off hot water?

Unfortunately, it is impossible to check and repair communication systems without a complete cessation of hot water supply.

These works also involve diagnostics of the main and distributing networks with a total length of over 15,000 kilometers, and the transfer of pipelines to more economical and modern analogues.

Ten days! Why so long?

MIPC believes that this period of time is quite reasonable and allows you to replace worn-out pipes, which inevitably deteriorate in winter from the cold, and also check all taps, valves and measuring instruments. Previously, preventive work required much more time. In 2011, for example, water was turned off for at least two weeks, and eight to ten years ago - for 21 days. The development of technology has reduced the shutdown time to ten days. Moreover, this year the city authorities have pleased the residents of the city that they will continue to reduce the term for turning off hot water.

If robotics are taught to check the condition of pipes, then prevention will take only two to three days.

Repair and maintenance work this year will affect more than 70,000 buildings, including approximately 33,000 residential buildings. Preparations for the next heating period will be completed by August 25.

In general, the Moscow heat supply development program is designed until 2020. In 2021, there will be no mass summer hot water shutdowns in the Russian capital, as the authorities assure. Hot water will be turned off for a maximum of three days, and even then not in all areas.

New builders are luckier?

Not really. The shutdowns will not affect houses that will be built under the housing renovation program. Moscow Mayor Sergei Sobyanin spoke about this in August last year. “But new houses will someday become old, and the need to turn off hot water, at least for a short time, will appear,” the head of the capital added.

However, this does not mean at all that only residents of new buildings will be able to avoid blackouts.

The need for prevention does not depend on the age of the houses, but on the pipes that run underground.

So, if you live in a house built in the century before last, and you know that it was recently held overhaul underground utilities, most likely, the utilities will not need to turn off your hot water.

OK. Is it even possible to save money on this?

It is possible, although the utilities are unlikely to tell you about it. If meters are installed in your apartment, turn off the hot water riser for the entire shutdown period . Otherwise, cold water that flows from the "red" tap will be billed as hot.

Is it just us?

Of course not. In some EU countries, in houses with central hot water supply, hot water is turned off every year, but for a short time. So, in Riga, the shutdown can last from several hours to two or four days, in Tallinn - one or two days. In Prague, hot water can be turned off for two weeks, and in Helsinki, hot water is only stopped in case of an accident on the heating mains.

Among the CIS countries, Moldova has the longest scheduled shutdown of hot water. There it is turned off for a month - from July to August.

However, the inhabitants of the country are not particularly worried about this, since due to the high cost of centralized hot water supply, it is easier for them to abandon it in favor of individual devices water heating and heating.

In Ukraine, scheduled shutdowns occur from April to August every year, last an average of two weeks and affect not only residential buildings, but also kindergartens, schools, and medical institutions. The situation is similar in Belarus. Although in some districts of Minsk the shutdown period was reduced, and it is 10-12 days.

However, in most countries of the world there is no practice of preventive shutdown of hot water, since they do not have centralized hot water supply systems. Cold water is simply heated by personal boilers in the apartments or with the help of general house heating.
